1. Agreement
These Terms govern your use of theunderfoot.com and any purchase you make from it. The site is operated by Underfoot, trading as Underfoot. By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.
You must be at least 18 years old, or the age of majority in your state, to place an order.
2. Products and descriptions
We describe our products as accurately as we can, including their limitations. The Underfoot grinder is designed for small and medium dogs and is not suitable for large dogs with thick nails. We state this on the product page and repeat it here.
Colors and finishes may vary slightly from images on the site, and packaging may differ from what is shown.
We may change products, discontinue them, or limit quantities at any time.
3. Specifications we do not publish
We do not publish decibel ratings, motor RPM, battery capacity, runtime, or charge time for this product. We have not independently tested those figures, and we are not willing to reprint unverified numbers supplied to us. Any such figures you encounter elsewhere did not come from us and should not be relied on.
4. Pricing and errors
Prices are in US dollars and may change without notice. We try hard to avoid errors, but if a product is listed at an incorrect price we reserve the right to cancel the order and refund you in full, whether or not the order has been confirmed. We will always contact you first.
5. Orders
Your order is an offer to buy. We may accept or decline it. We may refuse or cancel any order, including where we suspect fraud, where an address cannot be verified, or where a single customer places an unusual volume of orders.
6. Payment
You confirm that any payment method you use is yours and that you are authorized to use it. Payment is taken at the time of order.
7. Shipping, returns, and refunds
Our Shipping Policy and Refund and Return Policy are incorporated into these Terms by reference.
8. Not veterinary advice
This matters, so read it.
The content on this site, including the 7 day introduction plan, nail-trimming technique guidance, and anything we publish about dog behavior or grooming, is general information. It is not veterinary advice, and it is not a substitute for consulting a veterinarian or a qualified professional groomer.
Every dog is different. If your dog has a medical condition, an injury, dark nails you cannot see the quick through, a history of aggression or fear responses around handling, or any other complicating factor, speak to your vet before using this or any grooming tool.
Trimming nails carries a risk of injury. You can cut or grind into the quick, which bleeds and hurts. You can be bitten or scratched by a distressed animal. You use this product and follow our guidance at your own risk and at your own judgement. Stop if your dog is in distress.
If you cut or grind into the quick and bleeding does not stop within a few minutes, contact your veterinarian.
9. Safe use
Keep the grinder away from children. Do not use it near water or while it is charging. Do not disassemble it. Do not hold it against a single nail for extended periods, as friction generates heat. Supervise your dog at all times during use.
10. Your content
If you send us a review, photo, testimonial, or message, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display it in connection with our business, including in advertising. You confirm the content is yours to give and does not infringe anyone's rights. You can ask us to stop using it by emailing support@theunderfoot.com.
We do not have to publish anything you send, and we may remove content that is unlawful, abusive, or misleading.
11. Acceptable use
Do not use the site to break the law, infringe anyone's rights, transmit malware, scrape or harvest data, interfere with the site's operation, or impersonate anyone. We may terminate access for any of these.
12. Intellectual property
The Underfoot name, logo, site design, photography, and written content are owned by Underfoot and protected by intellectual property law. You may not copy or reuse them commercially without our written permission.
13. Third-party links
The site may link elsewhere. We do not control those sites and are not responsible for their content or practices.
14. Disclaimer of warranties
The site and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free.
This does not affect the Refund and Return Policy or the 60 day guarantee, which we honor as written.
15. Limitation of liability
To the fullest extent permitted by law, Underfoot and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or any product bought through it.
Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.
Some states do not allow certain limitations of liability. Where that is the case, these limitations apply to the maximum extent permitted in your state, and nothing here limits liability for fraud, gross negligence, or personal injury caused by our negligence where that cannot lawfully be limited.
16. Indemnity
You agree to indemnify Underfoot against claims arising from your breach of these Terms or your misuse of the site or products.
17. Governing law
These Terms are governed by the laws of the State of Massachusetts, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.
18. Severability
If any provision is found unenforceable, it is severed and the rest continues in force.
19. Changes
We may update these Terms. The current version is always on this page. Continuing to use the site after a change means you accept the updated Terms.
